Friendchise is a social platform for connecting people (“Friendchise,” “we,” or “us”).

We offer services that help individuals connect based on their interests (the “Services”) through our website https://friendchiseapp.com (the “Site”) and web application “Friendchise” (the “App”), collectively referred to as the “Platform.”

The Platform is owned and published by Friendchise.

The Platform is hosted by:

Bubble Group, Inc.

General Principles

These terms and conditions (the “General Terms”) form the sole agreement governing our contractual relationship. They define the terms of use and access to the Services provided to any user (“Client,” “you,” or “your”).

You can find these terms via a direct link at the bottom of the Platform’s pages.

By ticking the acceptance box during the registration process, you agree to the General Terms. If you do not agree with all the General Terms, you cannot access the Services.

Additional conditions may supplement these General Terms. In case of conflict, the additional conditions prevail.

These General Terms apply exclusively, overriding any other terms. Failure to exercise a right under these General Terms at any time will not constitute a waiver of such a right for the future nor imply modification of these terms.

Access to Services

Before creating an account on Friendchise, ensure you are eligible to use our Services.

We are committed to maintaining a respectful community. By using our Services, you warrant that:

You are an individual (not a legal entity or corporation) at least 18 years old or of legal age to enter into a contract under the laws of your country of residence.

You are a consumer, acting outside your professional activities.

You have the legal capacity to enter into a binding contract with Friendchise.

The law does not prohibit you from using our Services.

You have not committed or been convicted of a serious offense, sexual crime, or violent crime, unless pardoned for a non-violent crime, and you do not pose a threat to other users.

You have not been previously banned from our Services unless authorized in writing by us to create a new account.

If you no longer meet these requirements, your access to our App will be automatically revoked, and we may delete your access without notice.

Description of Services

The Service allow users to connect with each other based on preferences and interests, and create plans to meet for meals or drinks.

While we strive to provide meaningful connections, we cannot guarantee:

A specific gender ratio or age range

Compatibility with other users.

The Platform’s Services are limited to connecting people through the Platform.

Meeting other users is not part of our Service.

The users are in charge of making reservations and paying for what they have consumed. Our Service ends when users are connected on the platform for the same Plan.

The users must use their real name and photo when participating in the Service. If not complying with this, the user may be suspended from the platform.

After each meetup, users may receive a short questionnaire about their experience.

If you fail to follow these rules, you may receive a warning or be banned from the platform.

If you are found to have misrepresented your identity, we will first ask you to update your profile with accurate information. If you do not do so, your access to the platform may be suspended.

Friendchise Messaging Service

Friendchise provides access to a messaging feature (“Messaging”) for communication with participants. You agree to adhere to these General Terms during such exchanges.

Additional Services

Maintenance

During the Service period, we provide corrective and adaptive maintenance:

Corrective Maintenance: Addressing bugs or malfunctions reported on the Platform.

Adaptive Maintenance: Implementing improvements and adding new features or technical installations.

Scheduled maintenance may temporarily restrict or suspend access to the Platform. You must accept necessary updates to ensure optimal Service use. Failure to install updates may slow or degrade your access.

Hosting

We host the Platform and data on servers within Bubble’s servers operated by a professional hosting provider under an obligation of means.

Technical Support

For any technical difficulties, contact us using the details in the “Legal Notices” section.

Response times will vary based on the issue.

Your Obligations

By using our Services, you:

Provide Accurate Information: Guarantee the accuracy of the information submitted in the registration form and commit to keeping it updated.

Maintain Account Security: Ensure the confidentiality and security of your login credentials. Any access to the Platform using your credentials will be considered as performed by you. Notify us immediately if you suspect unauthorized use of your account.

Respect Laws and Guidelines: Comply with applicable laws, including local laws at the dinner location, and adhere to safety guidelines available at Friendchise’s safety tips.

Prohibited Activities

You agree not to:

Misrepresent your identity, age, or affiliations.

Solicit personal or financial information from other users.

Use another user’s account.

Conduct political campaign activities or seek to influence elections using the Platform, except to express personal opinions.

Share private or proprietary information without proper authorization.

Use meta tags, codes, or other references to Friendchise to redirect users to unrelated websites.

Develop or use third-party applications interacting with our Services without written consent.

Create a new account after being suspended or terminated, unless explicitly authorized.

You must also refrain from:

Exploiting the Services for unlawful or fraudulent purposes.

Violating any laws, regulations, or contractual obligations.

Promoting third-party services or engaging in unauthorized commercial activity.

Sharing content that is offensive, misleading, or violates third-party rights (including intellectual property or privacy rights).

Posting malicious software or harmful materials (e.g., viruses, spyware, or worms).

Using the Platform in ways that could harm Friendchise’s reputation or the integrity of its systems.

Content Restrictions

You are prohibited from sharing content that:

Is offensive, abusive, or causes psychological harm.

Violates public decency or is deemed inappropriate (e.g., pornographic, racist, or defamatory).

Contains false, fraudulent, or misleading information.

Includes unauthorized depictions of individuals (e.g., minors without parental consent).

If you fail to meet these obligations, we may immediately revoke access to our Services or events and take further measures as outlined under “Sanctions.”

Our Obligations

We are committed to delivering Services diligently and in compliance with applicable regulations.

Service Quality

We make every effort to ensure our Services are of high quality. Regular checks are conducted to verify functionality and accessibility. However, we are not liable for:

External network issues or server failures.

Equipment, service, or network interruptions outside our control.

User-induced configuration errors.

Data Protection and Security

We implement measures to safeguard Platform data, including:

Detection and Containment: Immediately isolating affected systems in the event of a data breach.

Incident Investigation: Conducting in-depth inquiries and documenting all findings.

Regulatory Notifications: Reporting breaches to relevant authorities (e.g., CNIL) or notifying affected individuals when required.

Content Responsibility

As a hosting provider, we are not responsible for user-generated content but will promptly act to remove illegal and harmful content upon notification.

Intellectual Property

The Platform, including software, databases, and content (texts, images, logos, etc.), is owned by Friendchise, and protected under intellectual property laws.

Limited License: You are granted a personal, non-transferable license to use the Platform for private purposes during the subscription period.

Prohibited Actions: Any reproduction, representation, or use of the Platform’s content for commercial purposes without prior written consent is strictly prohibited.

Use of Personal Attributes

By attending events or using Friendchise, you may be photographed or filmed. We may use such materials for promotional purposes for up to 3 years following your participation, unless you request removal earlier. You can withdraw consent at any time by contacting us.

Confidentiality

Each party agrees to keep the other party’s confidential information private for the duration of the agreement and three years beyond. This obligation does not apply to information:

Already known to the recipient.

Publicly available without breach of this clause.

Legally obtained from a third party.

Disclosed by judicial or regulatory requirement.

Confidential information may be shared with employees or subcontractors bound by equivalent confidentiality obligations.

Data Protection

Friendchise complies with the GDPR. Details on how personal data is processed and your related rights are available at Friendchise’s Privacy Policy.

Liability

Limitation of Responsibility

Friendchise cannot guarantee the accuracy, completeness, or precision of information provided on the Platform. Consequently, we disclaim all liability for errors, inaccuracies, or omissions in the information available.

Non-contractual Information: Texts and images related to Services are non-binding. Friendchise cannot be held responsible for errors in descriptions or visuals.

Plan-Related Liabilities: Friendchise is not responsible for the Plans. Our liability is strictly limited to the scope of the Services.

Scope of Liability

In all cases, Friendchise’s liability is limited to direct damages and shall not exceed the total amount paid by the Client in the 12 months preceding the event that caused the liability.

Withdrawal Rights

Force Majeure

Friendchise is not liable for delays or failures in fulfilling contractual obligations due to force majeure events.

In the event of force majeure:

The affected party must notify the other in writing (e.g., registered letter).

Obligations are suspended upon receipt of the notice and resume within a reasonable timeframe after the force majeure event ceases.

Both parties remain responsible for obligations not affected by the force majeure and any outstanding payment obligations.

Right of Withdrawal

If you reside in the European Union, you have the right to withdraw from your registration within 14 calendar days without providing any reason, provided you have not already started using the Service.

To exercise this right, you must notify us of your decision to withdraw by sending a clear written statement (e.g., by email) using the contact details provided in the Legal Notices section.

If your withdrawal is valid, any applicable payments made will be refunded without undue delay and no later than 14 calendar days from the day we receive your withdrawal notice. Refunds will be issued using the same payment method you used for the original transaction, unless otherwise agreed.
